Terms of Service
Who we are
These Terms are a binding agreement between you and Shanu Tyagi ("NumClash", "we", "us"). By creating an account or using the service you agree to these Terms.
NumClash is a real-time multiplayer guessing-game app with four games — Number, Word, Grid, and Bingo Clash — that share one account and backend. These Terms apply to all of them.
Use of the service
You must be at least 13 years old (or older where local law sets a higher minimum) to use the service. One account per person. Don't impersonate others. Don't share your account credentials.
If you use the service on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.
Account types
- Permanent account (Google / Apple / email): full access — random matchmaking, friends, private rooms, XP, premium.
- Guest account (anonymous sign-in): bot practice only. Guests cannot use random matchmaking, cannot add friends, and are not assigned a Player ID. You can link a guest account to a Google account at any time from Settings; doing so preserves your guest XP, history, and any other progress.
Behaviour
- No harassment, hate speech, threats, sexual content, or doxxing.
- No cheating: botting, multi-accounting to farm rewards, exploiting bugs without reporting them, or using modified clients.
- No attempts to disrupt the service, reverse-engineer it (except where local law expressly allows), or scrape it at scale.
- Reports filed by other users trigger moderator review. We may take action including warnings, temporary suspension, or permanent ban.
XP and progression
NumClash uses XP (experience points) to track your progression. XP is earned by playing — for example, by winning online matches. Matches are free to play. XP only ever increases; it is never spent, wagered, or staked.
XP has no monetary value. It cannot be bought, sold, redeemed for cash or anything of value, or transferred between users, and has no value outside the service. We may adjust how XP is earned to keep progression balanced.
NumClash contains no gambling and no wagering of any kind. Match outcomes are determined solely by skill (guess accuracy and timing); nothing of value is ever staked on a game.
Premium subscription
Premium is an optional auto-renewing subscription that removes ads and unlocks cosmetic perks (avatar frames, nameplates, profile backgrounds, Player-ID animations, a crown badge, and premium-only conveniences such as one-tap rematch). Premium is purely cosmetic and convenience — it does not affect game outcomes. Every match is decided by skill alone.
Billing. Subscriptions are sold and processed by the app store you purchase from — Apple (App Store) on iOS or Google (Google Play) on Android — not directly by us. Payment is charged to your store account when you confirm the purchase.
Auto-renewal. Your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the current period ends. Your store account is charged for renewal within the 24 hours before the period ends.
Managing and cancelling. Manage or cancel any time in your store account settings (App Store → your name → Subscriptions, or Google Play → Payments & subscriptions). Cancelling stops future renewals; you keep premium until the end of the period you've already paid for. Deleting the app does not cancel a subscription.
Refunds. Refunds for store purchases are handled by Apple or Google under their own policies; we do not directly process them. Any statutory withdrawal or refund right you have under local consumer law still applies.
Founder Player ID. Some yearly subscribers may be eligible to claim a low-numbered "founder" Player ID and a permanent founder badge. Once granted, the founder badge stays on the account for its lifetime even if the subscription later lapses; all other premium perks stop when the subscription ends.
We may change premium pricing or which perks are included, with notice; changes never affect a period you have already paid for.
User-generated content
By setting your display name, sending in-match reactions, or otherwise providing content to the service ("User Content"), you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display that content as needed to operate the service. You retain any underlying rights you have.
Your Player ID is allocated by us and is not User Content. Legacy @username values still held by older accounts are treated as User Content for moderation purposes.
You are responsible for User Content you submit and represent that it does not violate these Terms or any third-party rights.
Copyright (DMCA)
We respect intellectual-property rights. If you believe content on NumClash infringes your copyright, send a DMCA takedown notice to numclash@icloud.com with the following:
- identification of the copyrighted work claimed to be infringed,
- identification of the material that is claimed to be infringing and where it sits in the service (e.g. the username, in-match reaction, or asset URL),
- your name, postal address, telephone number, and email,
- a statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law,
- a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on behalf of the owner, and
- your physical or electronic signature.
We will review valid notices and remove or disable access to the infringing material in line with the Digital Millennium Copyright Act. Repeat infringers' accounts will be terminated.
If you believe your content was removed in error, you may submit a counter-notice to the same address with the corresponding DMCA counter-notice elements.
Account termination
You may delete your account at any time from Settings → Delete account (Danger zone, bottom of the Settings screen), or via our account deletion page.
We may suspend or terminate your account if you violate these Terms, if required by law, or to protect the service or other users. Where reasonable we will notify you of the reason. You may appeal by emailing numclash@icloud.com.
Modifications
We may add, change, or remove features at any time. We may update these Terms; if we make material changes we will notify you in-app and update the "Effective" date above. Continued use after the new effective date means you accept the updated Terms.
No warranty
The service is provided "as is" and "as available". We don't guarantee uptime, that any specific match will complete, or that the service will be error-free.
Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to the service is limited to the greater of (a) the amount you paid in the 12 months before the event giving rise to the claim, or (b) USD 10. The service is free to play; if you bought a premium subscription, amount (a) is limited to what you paid through the relevant app store in that period.
In no event will we be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill.
Indemnity
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your breach of these Terms, your User Content, or your misuse of the service, except to the extent caused by our wrongful act.
Force majeure
We are not liable for any failure or delay caused by events outside our reasonable control, including internet outages, third-party service failures, natural disasters, or government action.
Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Any dispute will be resolved exclusively in the courts of India, unless local consumer-protection law provides otherwise.
Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms (together with the Privacy Policy) are the entire agreement between you and us regarding the service.
